EPA Issues Supplemental Notice of Proposed Rulemaking on CAFOs: Comments due by April 7th

On March 7th, EPA posted a Supplemental Notice of Proposed Rulemaking to the June 2006 proposed Concentrated Animal Feeding Operations (CAFOs) rule. The supplemental rule would allow CAFO operators to exercise a voluntary option to self-certify that a CAFO does not discharge or propose to discharge based on an objective assessment of the CAFO's design,construction,operation and maintenance. CAFOs Hearing on Capitol Hill

On September 6th, 2007 the U.S. Senate Committee on Environment and Public Works (EPW) held a hearing entitled, "An Examination of the Potential Human Health, Water Quality, and Other Impacts of the Confined Animal Feeding Operation Industry." (Sep 30, 2007)

NCIFAP (National Commission on Industrial Farm Animal Production) Public Meetings on CAFOs

The National Commission on Industrial Farm Animal Production (NCIFAP), an independent non-profit entity, was formed last year to conduct an examination of key aspects of factory farming. This includes the industry's impact on public health, the environment, farm communities and animal health and well-being. The NCIFAP will be conducting several public hearings around the country. Federal Farm Bill Update

The federal Farm Bill is currently being re-authorized by Congress. The bill is comprehensive legislation that covers a wide array of agricultural programs and provides federal funding to farmers, ranchers, rural communities, and agri-business. (Jun 29, 2007)

Dangerous CAFOs Legislation

In March 2007, legislation was introduced that would exempt hazardous substances in livestock manure and other waste generated by concentrated animal feeding operations (CAFOs),from the reporting and clean-up requirements of the Comprehensive Environmental Response Compensation and Liability Act of 1980 (CERCLA or “Superfund”) and the Emergency Planning Community Right-to-Know Act (EPCRA). This News Just In On Capitol Hill CAFO Bills

A bill to exempt hazardous substances associated with livestock waste from CERCLA (Comprehensive Environmental Response, Compensation, and Liability Act, aka Superfund) (H.R. 4341) was discharged from the House Energy and Commerce Committee last week. Chairman Joe Barton (R-TX) reported the bill out of committee without any vote. CWN will continue to monitor the bill and report on any developments. Faulty Economic Analysis used to develop EPA’s Proposed CAFO Rule

During a recent EPA/CWN Environmental Stakeholders meeting with Assistant Administrator of Water Ben Grumbles, NRDC’s Melanie Shepherdson highlighted problems with the analysis underlying EPA’s June 30, 2006 proposed rule for concentrated animal feeding operations (CAFOs). An economic report commissioned by the Sierra Club highlights significant errors in EPA’s economic analysis on the cost effectiveness of a number of technologies to reduce pathogens in animal waste. CWN member groups at the stakeholders meeting urged EPA to make corrections to the analytical flaws identified by the economist. (Sep 28, 2006)

Congress Considers Bills that will Harm Clean Water by Exempting Factory Farms from Superfund

This summer, CWN organized a membership effort to draft and send a letter to Congress opposing two bills (H.R. 4341 and S.3681) which would exempt livestock manure contamination from the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, often referred to as Superfund).
