The Corps of Engineers has issued final notice of reissuance of Nationwide Permits (“NWP”) for dredged and fill materials that would increase flooding risks, write off protection of many streams and allow for senseless industry give aways that harm our waters. NWPs are general permits that permit certain activities that result in the dredge and fill of waters without the stricter review of the individual permit process.

The Network welcomes its newest member! The Ohio-based Sandusky County Citizens Protecting Our Resources, LLC (SC-CPR), recently joined the Clean Water Network by endorsing our National Agenda for Clean Water.

Representatives from SC-CPR have attended the Network's Regional Caucus on CAFOs in November and Clean Water Week here in DC.

H.R. 720, the Water Quality Financing Act passed the House floor 303-108, on Friday, March 9th. This legislation would reauthorize the Clean Water State Revolving Loan Fund, which provides vital funds to state and local governments to fix crumbling water infrastructure. The bill would reauthorize the Clean Water State Revolving Loan Fund at $14 billion over four years to help close the existing gap between current spending levels and wastewater infrastructure needs.

Bad news on the wetland ditching and drainage front. The US District Court in DC has ruled against the Corps and EPA and intervenors NWF, North Carolina Wildlife Federation and Sierra Club on the 2001 "Tulloch II Rule" regarding the definition of discharge of dredged material. This is a legal issue that's been at play in one forum or another since 1990 when developers started using the "Tulloch loophole" to drain thousands of acres of NC wetlands without a Corps 404 dredge and fill permit.

EPA Commits $10 Million to Protect the Nation's Beaches

Thirty states and five territories will share $10 million in grants for beach water-quality monitoring and public notification programs, the U.S. Environmental Protection Agency announced on January 9th. Beach water-quality monitoring helps local authorities identify what steps to take to reduce pollution and can lead to advisories or closures when bacteria concentrations reach unhealthy levels.

The National Commission on Industrial Farm Animal Production (NCIFAP), an independent non-profit organization, was formed last year to conduct an examination of key aspects of factory farming, including the industry's impact on the public’s health, the environment, farm communities and animal health and well-being. Commissioners represent diverse backgrounds and perspectives and come from the fields of veterinary medicine, agriculture, public health, business, government, rural advocacy and animal welfare.

This Monday (November 27th) was the deadline for submitting comments to the Army Corps of Engineers (Corps) regarding its proposed new package of nationwide permits (NWPs) pursuant to Section 404 of the Clean Water Act. The Network provided members with templates and other resources to help them submit their own comments. The comments submitted by the Kentucky Resources Coalition (see attached) is one example.

 On September 26, 2006, the Army Corps of Engineers (Corps) proposed a new package of nationwide permits (NWPs) pursuant to Section 404 of the Clean Water Act. The proposal renews the 44 nationwides that have been in effect for the last 5 years and are expiring in March 2007, including those that have proven to be especially destructive of streams and wetlands, such as the surface coal mining nationwide (mountaintop removal) NWP 21.
